Welcome to Rocket Agents. These Terms of Service ("Terms") govern your access to and use of the Rocket Agents platform, including our website, applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Service.

2. Description of Service

Rocket Agents provides an AI-powered customer relationship management (CRM) platform that includes:

  • Automated lead engagement via SMS, email, and voice
  • AI-driven conversation management, including AI Agent voice calls using voice synthesis technology
  • Lead qualification and scoring
  • Appointment scheduling automation
  • Analytics and reporting tools

3. Account Registration

To use our Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, TCPA, etc.)
  • Impersonate others or misrepresent your identity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any systems
  • Use the Service to harass, abuse, or harm others
  • Violate any applicable telecommunications regulations

5. Consent to Receive Communications

By creating an account or using our Service, you expressly consent to receive communications from Rocket Agents through any of the following channels:

  • Email: Account notifications, onboarding, product updates, service alerts, and promotional messages
  • SMS/Text Messages: Account verification, service notifications, alerts, and marketing communications
  • Voice Calls: Calls from our team regarding your account, service support, onboarding, and follow-ups
  • AI Agent Voice Calls: Automated calls powered by artificial intelligence and voice synthesis technology for account assistance, onboarding guidance, service updates, and promotional outreach

This consent applies to communications sent to the phone number(s) and email address(es) you provide at registration or add to your account at any time. You are not required to consent to receive promotional messages as a condition of purchasing any goods or services, but transactional and service-related communications are necessary for the operation of your account.

Opt-Out: You may revoke consent for promotional communications at any time by: (a) clicking "unsubscribe" in any email, (b) replying STOP to any SMS message, (c) requesting removal through your account settings, or (d) contacting us at our website. Opt-out requests will be processed within 10 business days. Opting out of promotional messages does not affect transactional or service-related communications.

SMS Opt-Out: Reply STOP to any SMS message to immediately stop receiving text messages. Reply HELP for assistance or support information. After sending STOP, you will receive a one-time confirmation message and no further texts will be sent unless you re-subscribe.

Rates: Message and data rates may apply. Message frequency varies based on account activity.

6. AI Communications Disclosure

Our Service uses artificial intelligence to communicate with leads on your behalf. You acknowledge and agree that:

  • AI-generated messages will be sent via email, SMS, and voice calls using your business identity
  • AI Agent voice calls use voice synthesis technology to conduct live conversations with leads
  • You are responsible for ensuring compliance with applicable disclosure requirements
  • Recipients may not always be aware they are communicating with an AI system
  • You will configure appropriate disclosures as required by law in your jurisdiction

7. Messaging and Communication Compliance

You are solely responsible for:

  • Obtaining proper consent before sending automated messages to your leads
  • Maintaining opt-out mechanisms and honoring unsubscribe requests
  • Complying with all applicable laws including TCPA, CAN-SPAM, GDPR, and similar regulations
  • Ensuring your contact lists are legally obtained and permission-based

8. Subscription and Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • Prices are subject to change with 30 days notice
  • You authorize us to charge your payment method for recurring fees
  • Refunds are handled according to our refund policy
  • Failure to pay may result in suspension or termination of your account

9. Intellectual Property

  • Rocket Agents retains all rights to the Service, including software, designs, and content
  • You retain ownership of your data and content uploaded to the Service
  • You grant us a license to use your data solely to provide the Service
  • Our trademarks and branding may not be used without permission

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID IN THE PRECEDING 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR THIRD-PARTY ACTIONS OR RESPONSES TO AI-GENERATED COMMUNICATIONS

12. Indemnification

You agree to indemnify and hold harmless Rocket Agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws
  • Communications sent through the Service on your behalf

13. Termination

  • You may cancel your account at any time through account settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your right to use the Service ends immediately
  • We may retain certain data as required by law

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Class action waivers apply to the extent permitted by law.

By using Rocket Agents, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
